What role do demand deposits serve in the financial system? The answer to this simple question has great implications in keeping the legal terms of the contract consistent with the demands of the financial system. Demand deposits are a perfect monetary substitute. Since money is only held to hedge against perceived uncertainty in both the timing and magnitude of future expenditures, demand deposits are demanded for the same reason. From this we derive three main conclusions. First, a financial contract similar (...) to a demand deposit cannot substitute for money. Second, full agreement to a financial contract does not create a perfect substitute for money unless it provides money’s two key characteristics: on demand and par value redemption. Finally, the demand for fractional-reserve demand deposits is fostered by an exogenous source and that demand for a good or service is not a sufficient condition to justify its legality or ethicality. Depositors have perceived banks as acting unethically during the most recent recession. One area of consternation is the ambiguity of the legal obligations entailed by the deposit contract when it is backed with only fractional reserves. In this article, we apply an existing analysis of the legitimacy and ethicality of banking practices to a wider range of financial transactions, including insurance policies, securities lending, perpetual bonds, and callable loans. Securities lending in particular creates rights violations analogous to those in fractional-reserve (...) banking. Both callable loans and perpetual bonds have clear legal obligations which are not inherently problematic, though we herein clarify what these obligations are. Finally, we apply our ethical framework to demonstrate that insurance products are distinct from banking deposit contracts, and that perceived parallels between the two products underestimate these differences. In the pages of this journal, a fruitful debate has evolved on the ethical legitimacy of fractional-reserve banking. In this article, we respond to the new arguments raised by Evans as we clarify our position on the unethical and illegitimate nature of fractional-reserve banking. Fractional-reserve banking is not a recent financial innovation but represents a long-standing legal aberration. The co-mingling of two mutually exclusive financial contracts, deposit and loan, confounds the contracting parties’ purposes, intents, rights, and obligations. As a result, (...) it creates unsolvable legal difficulties and ethical dilemmas. While these problems are most evident in the case of a bank run, they also arise when trying to answer the simple question of “who owns a deposit?”. (shrink)

The financial crisis has led to new interest in the ethics of financial markets. In this article, we further the debate on the nature of banking contracts by showing that the fundamental subjective purposes of loan and deposit contracts are irreconcilable. Any resultant mixture of the two contracts is a legal aberration. We consider a mutual fund as an important and legitimate alternative to the common demand deposit to provide high liquidity and some yield without offering full availability of a (...) nominal sum. Besides being a close substitute for how many deposit accounts function today, the mutual fund has the additional benefit of satisfying all legal and ethical requirements. Loan and investment contracts allow for the “bank” to make use of their clients’ funds while the intents of money owners are clearly classified without running into legal or ethical problems. We previously reported a high level of information on the Austrian organ donation law in medical and non-medical students, patients and ICU nurses, whereby ICU nurses at University Hospital in Graz (n = 185) were very well informed and also had the most critical view of the Austrian organ donation law.

The focus on translational research in clinical trials has the potential to generate clinically relevant genetic data that could have importance to patients. This raises challenging questions about communicating relevant genetic research results to individual patients. An exploratory pharmacogenetic analysis was conducted in the international ovarian cancer phase III trial, AGO-OVAR 16, which found that patients with clinically important germ-line BRCA1/2 mutations had improved progression-free survival prognosis. Mechanisms to communicate BRCA results were evaluated, because these findings may be beneficial to (...) patients and their families. Communicating individual BRCA results was not anticipated during clinical trial design. Consequently, options were not available for patients to indicate their preference for receiving their individual results when they signed pharmacogenetic informed consent. Differences in local requirements, clinical practice, and opinion regarding the ethical aspects of how to convey genetic results to patients are all potential barriers to returning individual BRCA results to patients. Communicating the aggregate BRCA result from this study provided clinical investigators with a mechanism to disseminate the overall study finding to patients while taking individual circumstances, local guidelines and clinical practice into account. This study illustrates the importance of increasing the clarity and scope of informed consent and the need for patient engagement to ensure clinical trial participants can indicate their preference regarding receipt of potentially important individual pharmacogenetic results. BackgroundNew metrics have been developed to assess the impact of research and provide an indication of online media attention and data dissemination. We aimed to describe online media attention of articles evaluating cancer treatments and identify the factors associated with high online media attention.MethodsWe systematically searched MEDLINE via PubMed on March 1, 2015 for articles published during the first 6 months of 2014 in oncology and medical journals with a diverse range of impact factors, from 3.9 to 54.4, and selected (...) a sample of articles evaluating a cancer treatment regardless of study design. Altmetric Explorer was used to identify online media attention of selected articles. The primary outcome was media attention an article received online as measured by Altmetric score (i.e., number of mentions in online news outlets, science blogs and social media). Regression analysis was performed to investigate the factors associated with high media attention, and regression coefficients represent the logarithm of ratio of mean (RoM) values of Altmetric score per unit change in the covariate.ResultsAmong 792 articles, 218 (27.5%) received no online media attention (Altmetric score = 0). The median [Q1–Q3] Altmetric score was 2.0 [0.0–8.0], range 0.0–428.0. On multivariate analysis, factors associated with high Altmetric score were presence of a press release (RoM = 10.14, 95%CI [4.91–20.96]), open access to the article (RoM = 1.48, 95%CI [1.02–2.16]), and journal impact factor (RoM = 1.10, 95%CI [1.07–1.12]. As compared with observational studies, systematic reviews were not associated with high Altmetric score (RoM = 1.46, 95%CI [0.74–2.86]; P = 0.27), nor were RCTs (RoM = 0.65, 95%CI [0.41–1.02]; P = 0.059) and phase I/ii non-RCTs (RoM = 0.58, 95%CI [0.33–1.05]; P = 0.07). The articles with abstract conclusions favouring study treatments were not associated with high Altmetric score (RoM = 0.97, 95%CI [0.60–1.58]; P = 0.91).ConclusionsMost important factors associated with high online media attention were the presence of a press release and the journal impact factor. There was no evidence that study design with high level of evidence and type of abstract conclusion were associated with high online media attention. (shrink)

We estimate that 208,000 deep brain stimulation (DBS) devices have been implanted to address neurological and neuropsychiatric disorders worldwide. DBS Think Tank presenters pooled data and determined that DBS expanded in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. The DBS Think Tank was founded in 2012 providing a space where clinicians, engineers, researchers from industry and academia discuss current and emerging DBS technologies and logistical and ethical issues facing the field. (...) The emphasis is on cutting edge research and collaboration aimed to advance the DBS field. The Eighth Annual DBS Think Tank was held virtually on September 1 and 2, 2020 (Zoom Video Communications) due to restrictions related to the COVID-19 pandemic. The meeting focused on advances in: (1) optogenetics as a tool for comprehending neurobiology of diseases and on optogenetically-inspired DBS, (2) cutting edge of emerging DBS technologies, (3) ethical issues affecting DBS research and access to care, (4) neuromodulatory approaches for depression, (5) advancing novel hardware, software and imaging methodologies, (6) use of neurophysiological signals in adaptive neurostimulation, and (7) use of more advanced technologies to improve DBS clinical outcomes. There were 178 attendees who participated in a DBS Think Tank survey, which revealed the expansion of DBS into several indications such as obesity, post-traumatic stress disorder, addiction and Alzheimer’s disease. From mass murder to genocide, slavery to colonial suppression, acts of atrocity have lives that extend far beyond the horrific moment. They engender trauma that echoes for generations, in the experiences of those on both sides of the act. Gabriele Schwab reads these legacies in a number of narratives, primarily through the writing of postwar Germans and the descendents of Holocaust survivors. She connects their work to earlier histories of slavery and colonialism and to more recent events, such as South (...) African Apartheid, the practice of torture after 9/11, and the "disappearances" that occurred during South American dictatorships. Schwab's texts include memoirs, such as Ruth Kluger's _Still Alive_ and Marguerite Duras's _La Douleur_; second-generation accounts by the children of Holocaust survivors, such as Georges Perec's _W_, Art Spiegelman's _Maus_, and Philippe Grimbert's _Secret_; and second-generation recollections by Germans, such as W. G. Sebald's _Austerlitz_, Sabine Reichel's _What Did You Do in the War, Daddy?_, and Ursula Duba's _Tales from a Child of the Enemy_. She also incorporates her own reminiscences of growing up in postwar Germany, mapping interlaced memories and histories as they interact in psychic life and cultural memory. Anthropologists have recently argued that the divide between nature and culture is not a universal framework suitable for understanding collective behavior but rather a local variation among various ways of composing the experience of the world. Notably, in the case of Philippe Descola’s anthropology, this critique led to a radical reconceptualization of social sciences and the humanities in terms of ontological regimes, which draws upon key aspects of the phenomenological tradition. In this paper, I develop a phenomenological perspective on Descola’s (...) anthropology to clarify whether and how we can assess our engagement with the world beyond the divide between nature and culture. The paper is divided into three sections. In the first section, I present the main claims of Descola’s position, which he calls “relative universalism,” and introduce two critiques of this project: the potential conflation between his ontological framework and aspects of modern naturalism and the risk of reifying cultural determinations as ontological properties. In the second section, I address the first critique by showing how the universalist claim of Descola’s anthropology, according to which collective experience is organized by the duality of planes of physicality and interiority, can be elucidated through Husserl’s account of the embodied experience to avoid a conflation with the naturalist framework. Finally, I contend that anthropology’s idea of a diversity of ontological regimes can be made coherent by analyzing the two layers of the world constitution: the primordial experience of the lived body and the intersubjective process of communalization. En este artículo, en el marco del surgimiento de los nuevos realismos del siglo XXI y de su manifestación en el ámbito latinoamericano, se aborda en particular el Nuevo Realismo Analógico de Mauricio Beuchot. El filósofo mexicano entiende que gran parte de los desarrollos filosóficos del siglo XX han conducido al relativismo, y que, dadas las consecuencias socio-políticas producidas, es necesario resarcir el realismo. En este trabajo se problematiza la posibilidad de resarcir el realismo y evitar el relativismo partiendo de (...) las mismas bases que las de las filosofías cuestionadas. Nuestro objetivo es revisar uno de los supuestos ontológicos y epistemológicos subyacentes a dicho realismo y evaluar los alcances de este, cuestionando al mismo tiempo su declarada criticidad. Dicho análisis nos permitirá sostener, basado en los estudios antropológicos de Philippe Descola, que el realismo de Beuchot sucumbe al mismo relativismo que cuestiona y, en consecuencia, desde esta perspectiva, su propuesta es insuficiente para resarcir el realismo y evitar el relativismo. The aim of this paper is to shed light on and develop what I call a phenomenological conception of experiential justification. According to this phenomenological conception, certain experiences gain their justificatory force from their distinctive phenomenology. Such an approach closely connects epistemology and philosophy of mind and has recently been proposed by several authors, most notably by Elijah Chudnoff, Ole Koksvik, and James Pryor. At the present time, however, there is no work that contrasts these different versions of PCEJ. This (...) paper not only bridges this gap, but also reveals problems in current versions of PCEJ. Consequently, I argue for a new version of PCEJ that focuses on what is given within experience and not on how what is given pushes me towards believing something. (shrink)

‘India’s founding moment’ a moment of breath-taking political imagination and it is one of the great achievements of Madhav Khosla. to unpack important parts of its pre-history and emergence. This article will look at two questions—one about alternatives and the other about contexts. Regarding alternatives, I am interested in the paths not taken and an understanding of possibilities. I try to get a sense of possible alternative futures or modernities that the founding generation pondered, in the best case allowing us (...) to wonder what we can learn from the choices made as well as from the paths rejected. The other question I raise is the question of the intellectual contexts, in which the founding took place. Coming from a non-Indian perspective, I am interested in the entanglements, the contexts and potentially migrating ideas that emerge. (shrink)

In 1981, David Hubel and Torsten Wiesel received the Nobel Prize for their research on cortical columns—vertical bands of neurons with similar functional properties. This success led to the view that “cortical column” refers to the basic building block of the mammalian neocortex. Since the 1990s, however, critics questioned this building block picture of “cortical column” and debated whether this concept is useless and should be replaced with successor concepts. This paper inquires which experimental results after 1981 challenged the building (...) block picture and whether these challenges warrant the elimination “cortical column” from neuroscientific discourse. I argue that the proliferation of experimental techniques led to a patchwork of locally adapted uses of the column concept. Each use refers to a different kind of cortical structure, rather than a neocortical building block. Once we acknowledge this diverse-kinds picture of “cortical column”, the elimination of column concept becomes unnecessary. Rather, I suggest that “cortical column” has reached conceptual retirement: although it cannot be used to identify a neocortical building block, column research is still useful as a guide and cautionary tale for ongoing research. Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. In the course of his paper, I demonstrate the advantages of the phenomenological conception and defend it against a recent objection. (shrink)

In current debates, many philosophers of science have sympathies for the project of introducing a new approach to the scientific realism debate that forges a middle way between traditional forms of scientific realism and anti-realism. One promising approach is perspectivism. Although different proponents of perspectivism differ in their respective characterizations of perspectivism, the common idea is that scientific knowledge is necessarily partial and incomplete. Perspectivism is a new position in current debates but it does have its forerunners. Figures that are (...) typically mentioned in this context include Dewey, Feyerabend, Leibniz, Kant, Kuhn, and Putnam. Interestingly, to my knowledge, there exists no work that discusses similarities to the phenomenological tradition. This is surprising because here one can find systematically similar ideas and even a very similar terminology. It is startling because early modern physics was noticeably influenced by phenomenological ideas. And it is unfortunate because the analysis of perspectival approaches in the phenomenological tradition can help us to achieve a more nuanced understanding of different forms of perspectivism. The main objective of this paper is to show that in the phenomenological tradition one finds a well-elaborated philosophy of science that shares important similarities with current versions of perspectivism. Engaging with the phenomenological tradition is also of systematic value since it helps us to gain a better understanding of the distinctive claims of perspectivism and to distinguish various grades of perspectivism. The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. The inherent value conception of dignity,as here defended, is what is meant in the Swiss Constitution article. (shrink)

How ethical have recent banking practices been? We answer this question via an economic analysis. We assess the two dominant practices of the modern banking system – fractional reserves and maturity transformation – by gauging the respective rights of the relevant parties. By distinguishing the legal and economic differences between deposit and loan contracts, we determine that the practice of maturity transformation (in its various guises) is not only ethical but also serves a positive social function. The foundation of the (...) modern banking system – the holding of fractional reserves against deposits – is, however, problematic from economic, legal and ethical perspectives. Starting from a microanalysis of money's function, a reassessment of the current laws concerning the practice is encouraged, with the aim not only to rectify economic irregularities but also to realign depositors' rights with the obligations of the banking sector. In this paper, I shall show that for Husserl, (a) evidence determines epistemic justification and (b) evidence is linked to originary givenness in the sense that one's ultimate evidence consists of one's originary presentive intuitions. This means that in contemporary analytic terminology, Husserl is a proponent of evidentialism and mentalism. Evidentialism and mentalism have been introduced into current debates by Earl Conee and Richard Feldman. Finally, I shall highlight that there is one significant difference between Husserl and Earl Conee and (...) Richard Feldman. Although Conee and Feldman argue that the fundamental principles of epistemology are principles of best explanation, Husserl opts for phenomenological principles as the most fundamental epistemic principles. The main difference is that for Husserl, experiences gain their justificatory force by virtue of their phenomenal character, namely, their originary givenness. (shrink)

As is well known, the late Husserl warned against the dangers of reifying and objectifying the mathematical models that operate at the heart of our physical theories. Although Husserl’s worries were mainly directed at Galilean physics, the first aim of our paper is to show that many of his critical arguments are no less relevant today. By addressing the formalism and current interpretations of quantum theory, we illustrate how topics surrounding the mathematization of nature come to the fore naturally. Our (...) second aim is to consider the program of reconstructing quantum theory, a program that currently enjoys popularity in the field of quantum foundations. We will conclude by arguing that, seen from this vantage point, certain insights delivered by phenomenology and quantum theory regarding perspectivity are remarkably concordant. Our overall hope with this paper is to show that there is much room for mutual learning between phenomenology and modern physics. (shrink)

Even now, however, Wegener's work remains virtually unknown to the English speaking world. Wegener's main work was published in 1885. It has its origin in two lectures given in 1883 and 1884 at school teacher meetings held in the Magdeburg area and it still recalls those (...) original occasions and maintains much of the oral style. Part of the volume treats the subject in a systematic and theoretical manner; other sections contain vivid examples and are characterized by a considerable didactic effort. The book is held together by leitmotif-questions, such as 'How do we understand language?' and 'How does language function as a means of everyday communication?'. We witness the experiences of the talented school teacher and the observations of the innovative dialect researcher combined, condensed, and conceptually ordered.In spite of the relatively unsystematic form of presentation, the book remains thoroughly consistent in thought and argument. In the Untersuchungen we have before us the outline of a communicative and functional view of language structure, of the analysis of speech, and of semantics. (shrink)

Can phenomenologists allow for the existence of unobservable entities such as atoms, electrons, and quarks? Can we justifiably believe in the existence of entities that are in principle unobservable? This paper addresses the relationship between Husserlian transcendental phenomenology and scientific realism. More precisely, the focus is on the question of whether there are basic epistemological principles phenomenologists are committed to that have anti-realist consequences with respect to unobservable entities. This question is relevant since Husserl’s basic epistemological principles, such as the (...) “principle of all principles,” seem to suggest that epistemic justification is limited to what can be originally given in the sense that if an object cannot be given in an originary presentive intuition, then one cannot be justified in believing that this object exists. It is the main aim of this paper to show (i) that interpretative reasons exist for not reading Husserl in such a way and (ii) that systematic reasons exist as to why phenomenologists should not subscribe to this criterion. I shall put forward a different criterion of justification that satisfies the spirit of Husserlian transcendental phenomenology and allows for justifiably believing in the existence of unobservable scientific entities. Moral responsibility for an action can only be ascribed if it allows inferences about the agent. In cases of negligence, such a connection appears absent, as the agent acts in ignorance of readily accessible relevant facts. Yet, we hold individuals accountable for their negligent actions. The literature presents two approaches to resolve this apparent contradiction: Derivative theories trace negligence back to prior culpable misconduct, while non-derivative theories view negligent actions as expressions of blameworthy attitudes. However, there are cases that neither (...) approach can adequately explain. This paper aims to justify the appropriateness of moral blame even in these stubborn instances. Central to such a justification is the manner in which the ignorance arises. Often, it results from the violation of epistemic duties, which obligate us to maintain awareness of the consequences our actions have for others. This misconduct thus establishes the necessary connection between the agent and the negligent action, providing a basis for attributing responsibility. (shrink)

The right to privacy extends only to information through which the persons concerned are identifiable. This assumption is widely shared in law and in philosophical debate; it also guides the handling of personal data, for example, in medicine. However, this essay argues that the dissemination of anonymous information can also constitute a violation of privacy. This conclusion arises from two theses: (1) From the perspective of the affected person, judgments by others about anonymous information refer to its originator, even if (...) outsiders do not know who it is; (2) Our self-understanding is co-constituted by the judgment of others about us. This is a consequence of our social nature. There are certain areas of our lives that we do not want to expose to the gaze of others for our own sake. Therefore, the unauthorized dissemination of information concerning these areas can violate our privacy even if they are anonymous. While the question of the extent of privacy poses a general problem, there are reasons to discuss it in the context of digital medicine. (shrink)

This paper discusses citizenship in Finnish religious education in relation to human security. It traces the characteristics of human security that connect citizenship, religion, and education in Finnish policy documents. The article focuses on basic education. Its data were analyzed employing qualitative content analysis. The findings indicate that citizenship in Finnish RE entails personal security concerns dealing with psychological and human rights issues. These are found to be essentially human security as conceptualized by the United Nations. However, Finnish policy documents (...) sparingly utilize human security in explicit terms. Finland rather emphasizes the practical applications of human security. Incorporation of explicit global citizen and human rights issues into RE in the new Finnish curriculum seems to project critical global citizenship. This is found to promote human security. Following Finland’s bid for practical application of human security, we recommend that human security be explicitly integrated into the Finnish RE curriculum. (shrink)

Primero reivindicar para la alteridad la misma legitimidad filosófica de categorías consoliddadas como la identidad. Después explorar las diferencias internas a la alteridad en su despliegue temporal o histórico y espacial o (multi)cultural. Tercero, asociar la alteridad a la ética y sus diferencias para, en cuarto lugar, centrar el argumento en la alteridad ética de Emmanuel Levinas articulada, como se sabe, (...) en torno a la categoría del “otro” que, al presentarse como “rostro”, aparece como la expresión de la vulnerabilidad misma. Esta vulnerabilidad abstracta – en quinto lugar – se concreta como vulnerabilidad migratoria, efecto de condiciones socio-culturales determinadas cuyo portador, el emigrante (sobre todo el musulmán y el subshariano) encarna por derecho propio la figura filosófica del otro levinasiano y su interpelación por la justicia.
